1. About this program

RallyComm Operational Messaging is the SMS service that ships with every RallyComm hardware device. It allows the device operator (driver, co-driver, crew chief, or event safety official) to send operational messages to a small set of recipients they have personally added to their device. Typical messages include pre-canned button alerts ("OK", "rolled", "need fuel", "medical"), GPS position pings with map links, service-interval reminders, and auto-replies to inbound messages from those same recipients.

Message and data rates may apply — the recipient's wireless carrier may charge for incoming SMS. RallyComm does not bill recipients for messages they receive.
Opt-out
Reply STOP to any message from a RallyComm device to immediately stop receiving messages from that device. Twilio honors STOP automatically across the carrier.

Supported carriers
All major U.S. carriers including AT&T, T-Mobile, Verizon, US Cellular, and their MVNOs.

3. Operator responsibilities

When you purchase a RallyComm device and add a phone number to its recipient list, you represent and warrant that:

  1. The recipient is a person you personally know — typically a member of your racing team, your family, an event official, or an emergency contact.
  2. You have obtained that person's express consent, verbally or in writing, to receive operational SMS messages from your RallyComm device.
  3. You will remove that recipient promptly if they ask you to stop sending or reply STOP to a message.
  4. You will not use the device to send marketing, promotional, or commercial solicitation messages.
  5. You will not use the device to send messages prohibited by the CTIA Short Code Monitoring Handbook, including content related to sex, hate, alcohol, firearms, tobacco, or any unlawful activity.

Before saving a new recipient, the device's local web UI presents a consent confirmation prompt that you must explicitly check acknowledging these obligations. A screenshot of that prompt is published at /assets/consent-screenshot.png.

5. Hardware and subscription

RallyComm devices are sold as physical hardware. Once purchased, the device is yours and can run indefinitely without a subscription. Operational SMS, however, requires an active subscription tier — Weekly (a one-time 7-day pass that does not auto-renew) or Monthly (auto-renewing until cancelled). Cancelling a subscription stops outbound SMS within minutes and releases the device's Twilio number back to the carrier pool. The hardware continues to function for cellular data, GPS, and Zello voice (if configured) regardless of SMS subscription state.

6. Service availability and limitation of liability

RallyComm makes commercially reasonable efforts to keep the SMS service operating, but the underlying carriers (AT&T, T-Mobile, Verizon) and our SMS partner Twilio control message delivery and may delay, throttle, or reject messages without notice. RallyComm is not liable for non-delivery, delayed delivery, or any consequence resulting from a recipient's failure to receive a message. Do not rely solely on RallyComm SMS for life-safety situations — always pair with a satellite messenger or emergency beacon (Garmin inReach, ZOLEO, ResQLink, etc.) when operating in areas where cellular coverage is uncertain.

To the maximum extent permitted by law, RallyComm and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the device or service, including lost profits, lost data, or bodily injury. Total liability is limited to the amount you paid RallyComm in the twelve (12) months preceding the claim.

Hardware: 30-day money-back guarantee from delivery, less return shipping. Subscription: weekly passes are non-refundable; monthly subscriptions can be cancelled any time and the current period runs out — no pro-rated refunds.

8. Intellectual property

RallyComm and the RallyComm logo are trademarks of RallyComm. The device firmware is proprietary; you receive a non-transferable license to operate the firmware on the hardware you purchased. Not affiliated with AIM Sportline, Blink Marine, Twilio, Hologram, or Zello — those trademarks belong to their respective owners.

9. Governing law and dispute resolution

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association in Travis County, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual-property infringement.

10. Changes to these terms

We may update these terms from time to time. Material changes will be announced to active customers by email at least 30 days before taking effect. Continued use of the device after the effective date constitutes acceptance.
